These Terms and Conditions (“T&C”) govern your (“User”, “you”, “your”) access to and use of the ZISHES platform, including our websites, mobile applications, games, tournaments, leaderboards, marketplace features, and related services (collectively, the “Platform”), operated by Zishes (“Provider”, “we”, “us”, “our”).
By creating an account, using Free Plays, purchasing Game Zone Charges, participating in leaderboards or tournaments, listing an item as a seller, or otherwise using the Platform, you agree to be bound by these T&C and all related policies referenced herein. If you do not agree, do not use the Platform.
The Platform is designed to follow a global compliance-first standard. We aim to comply with all applicable local laws in each region where the Platform is available, as well as relevant international standards for consumer protection, advertising, payments, and data protection. Where rules differ by region, we may restrict features, add region-specific terms, or decline to offer certain services.
ZISHES is a skill-based entertainment and commerce Platform. The Platform is not intended to provide facilities for gambling in any jurisdiction. We do not offer betting, wagering, or odds-based games. Gameplay outcomes and leaderboard rankings are based on skill performance metrics.
Where product tournaments and prize promotions are offered, they are intended to be structured as lawful skill competitions or permitted prize promotions in accordance with applicable local laws and advertising standards.
Great Britain note (where applicable): where the Platform is made available in Great Britain (England, Wales, Scotland), we structure promotions and communications to align with relevant UK frameworks, including skill/promotion principles under the Gambling Act 2005 (GB), the CAP Code (ASA), and UK consumer laws. This note is not exclusive and does not limit our global compliance approach.
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Platform. You must also have the legal capacity to enter into contracts and must not be prohibited from using the Platform under applicable law, sanctions, or compliance restrictions.
We may require identity, age, and/or location verification to enforce eligibility, prevent fraud, protect users, and comply with legal obligations. Failure to provide requested information may result in restricted access, suspension, or termination.
You are responsible for your login credentials and all activity on your account. You must not impersonate others or provide false or misleading information. You may only create one account unless we explicitly allow otherwise.
ZISHES may suspend or terminate accounts for breaches of these T&C, suspected fraud, abuse, cheating, verification failure, or non-compliance. Please notify us immediately if you suspect unauthorised use.
The Platform includes a Game Zone offering skill-based games. Unless otherwise stated, Users receive two (2) Free Plays per calendar day. Free Plays provide a clear and genuine free method of participation.
After Free Plays are used, Users may optionally purchase Game Zone Charges to access additional gameplay sessions. Game Zone Charges:
Prices, taxes (VAT/GST where applicable), and billing terms will be shown before purchase.
Users may enter Weekly Leaderboards via skill-based gameplay. Free Plays provide access to leaderboard participation without payment. Leaderboard rankings are determined by objective performance metrics (e.g., score, accuracy, speed, streaks), as disclosed in the game or event rules.
Leaderboards are final except where we determine that cheating, exploitation, technical faults, or rule violations materially impacted results.
Eligible leaderboard winners may receive Tournament Charges as a reward for performance (for example, 5 Tournament Charges). Tournament Charges:
Purchasing Game Zone Charges does not convert into Tournament Charges and does not guarantee receipt of Tournament Charges.
Certain tournaments on the Platform are linked to specific physical products. Entry into such tournaments is made using Tournament Charges (not money). The number of Tournament Charges required for entry, and all significant conditions (dates, rules, winner selection, eligibility, product details), are disclosed in the relevant Promotion Terms.
Tournament outcomes are determined by disclosed skill-based criteria and Platform integrity controls. No cash alternative is offered unless required by law.
The Platform may allow verified Sellers (including users acting as sellers) to list products for tournaments. Every Seller and every product is subject to verification before it becomes eligible for listing or tournament use.
Seller verification may include identity checks, contact checks, ownership/source documentation, compliance screening, and risk controls. Product verification may include authenticity checks, condition checks, and safety/compliance checks. Counterfeit or prohibited items are not allowed and may result in withheld payouts, suspension, termination, or legal action.
ZISHES generates revenue primarily from Game Zone Charges (paid gameplay access). For a product tournament, ZISHES may calculate the payout to the Seller based on the stated Product Value and the Platform Fee.
Platform Fee: unless otherwise disclosed, ZISHES charges a platform service fee of 30% of the Product Value for verification, payment processing, platform operation, and tournament administration.
Illustrative example: if a Seller lists a product with a Product Value of £1,000 and the relevant tournament completes, ZISHES may pay the Seller:
Seller payouts may be subject to additional verification, compliance, tax withholding, and fulfilment requirements. Sellers must provide accurate product descriptions and fulfilment cooperation.
Prize delivery: the tournament winner receives the physical product. Fulfilment may be handled by the Seller, ZISHES, or a logistics partner. Delivery timelines, shipment proof requirements, and region restrictions are disclosed in Promotion Terms or listing details. Winners may be responsible for customs duties and import taxes where applicable.
Refund eligibility depends on your region, statutory rights, and store/payment provider policies. Where a tournament is cancelled, we may re-run the tournament, substitute a fair alternative, or return Tournament Charges as appropriate. Game Zone Charges may be non-refundable once gameplay access is delivered, subject to your mandatory consumer rights.
You agree to provide information reasonably required for identity, age, sanctions, fraud-prevention, and compliance checks. ZISHES may restrict, freeze, suspend, or terminate accounts if verification is not completed or if prohibited activity is suspected.
You retain ownership of content you submit but grant ZISHES a non-exclusive licence to host, store, display, and use it for Platform operation, safety, moderation, promotion of results where required, and other purposes described in our Privacy Policy. You warrant that your content does not infringe third-party rights.
All Platform software, games, visuals, trademarks, and other intellectual property are owned by or licensed to ZISHES. You must not copy, reverse engineer, or misuse Platform IP except as allowed by law.
Disputes should first be raised with ZISHES Support. Governing law and dispute forum may vary based on the region where you access the Platform and the contracting entity providing the service. Mandatory consumer protections remain unaffected.
Great Britain note (where applicable): where GB terms apply, the contract is governed by the laws of England and Wales, and courts of England and Wales have jurisdiction, without prejudice to non-waivable consumer rights.
Nothing in these T&C excludes liability that cannot be excluded under applicable law (including fraud, or death/personal injury caused by negligence where applicable). To the extent permitted by law, ZISHES is not liable for indirect or consequential damages, loss of profits, loss of data, or loss of goodwill.
Our aggregate liability to you for foreseeable losses is limited to the higher of USD 100 (or local equivalent) or the amount you paid ZISHES in the preceding 12 months, unless a higher cap is required by law.
We may update these T&C to reflect legal, safety, product, or operational changes. Continued use after changes take effect constitutes acceptance, subject to mandatory consumer protections.
